The Guild of Jewellery Designers Trusted Designer/Maker Agreement


Membership

 

Members of The Guild of Jewellery Designers can apply to be a Guild of Jewellery Designers Trusted Designer/Maker subject to this agreement, which is deemed to include the Guild of Jewellery Designers Code of Conduct (the Code).  The Guild of Jewellery Designers will accept a member’s application if it is satisfied, acting reasonably, that the member is an honest and reputable jewellery designer/maker capable of adhering to the Code.

The member shall supply The Guild of Jewellery Designers with such information (and access to its premises) as The Guild of Jewellery Designers may reasonably request from time to time for the purpose of satisfying itself that the member is an honest and reputable maker, adhering with, and able to continue to adhere with, the Code.

 

Subscription Fees

 

The member shall pay The Guild of Jewellery Designers the annual or monthly subscription fee raised on Guild of Jewellery Designers Trusted Designer/Makers.  The subscription fee shall be such as The Guild of Jewellery Designers may from time to time adjust. Two categories of member currently exist and Members may fall in to a category that carries a higher subscription charge.

 

Termination

 

The member will cease to be a Guild of Jewellery Designers Trusted Designer/Maker if:

The member cancels his/her membership subscription in the member account dashboard.

The Guild of Jewellery Designers gives the member written notice of a failure by the member to adhere to this agreement and the member has failed to redress the failure within 30 days; or

The Guild of Jewellery Designers gives the Trusted Designer/Maker member not less than 30 days previous notice of expiry of this agreement on the grounds that the member is no longer, in the opinion of The Guild of Jewellery Designers, an honest and reputable maker capable of adhering to the Code or acting reasonably,.

On termination of this agreement, the member will immediately discontinue displaying the The Guild of Jewellery Designers name and the Trusted Designer/Maker logo on its website and will not otherwise claim or suggest that it is a Guild of Jewellery Designers Trusted Designer/Maker.

 

The Guild of Jewellery Designers Code of Conduct

 

The member agrees to comply with the Code of Conduct for the duration of this agreement.

 

The Guild of Jewellery Designers Trusted Designer/Maker logo.

 

The Guild of Jewellery Designers Trusted Designer/Maker logo is shown as the following and may be subject to change in a timeframe that The Guild of Jewellery Designers determine, the Trusted Designer/Maker will not display the Trusted Designer/Maker logo otherwise than in its current format nor display part only of the Trusted Designer/Maker Logo:

The member may describe itself as a “Guild of Jewellery Designers Trusted Designer/Maker” and display the Trusted Designer/Maker Logo on its website and other media via which it advertises (Digital or printed).

The Trusted Designer/Maker member’s website or associated websites will prominently display the Trusted Designer/Maker logo which is hyperlinked to the The Guild of Jewellery Designers unique identification certificate issued and maintained by The Guild of Jewellery Designers by means of a script. The corresponding display for each Trusted Designer/Maker member will contain links to the Guild of Jewellery Designers code of conduct and the member’s Designer Directory listing.

If the member deals in goods or services other than jewellery, the member will not on any website or part of its website which concerns these goods or services, use the words “Guild of Jewellery Designers Trusted Designer/Maker”, the Trusted Designer/Maker Logo or any other Guild of Jewellery Designers logo or otherwise suggest that such goods or services are part of the The Guild of Jewellery Designers Trusted Designer/Maker scheme.

 

Intellectual Property

 

All rights of intellectual property in the name The Guild of Jewellery Designers, the Trusted Designer/Maker logo and all other associated logos are the property of The Guild of Jewellery Designers.  The member may use them only as expressly permitted in this agreement and in the Conditions of Use For The Guild of Jewellery Designers Collective Mark

 

The Guild of Jewellery Designers

 

The Guild of Jewellery Designers Trusted Designer/Maker is a trading name of the The Guild of Jewellery Designers Ltd.

 

Governing law and jurisdiction

 

Each of the parties to this Agreement irrevocably agrees that the courts of England shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or in connection with this Agreement or its formation or validity and, for these purposes, each party irrevocably submits to the jurisdiction of the courts of England.
